RIGHTS VIOLATED IN MARSDEN'S CASE

Marsdens right to due process was violated when Det Re, Det Hoctor, Det McHugh;were allowed to testify about alleged statements made by Mr .Marsden that were false a wholly unreliable when compared by lack of drug, ballistic and forensic evidence left at the scene.

  • ineffective assistance of counsel on grounds the trial council.

  • failed to call forensic expert

  • failed to call forensic pathologist to refute false testimony

  • failed to move to preclude the statements allegedly made by Mr.Marsden based upon the peoples failure to corroborate these statements pursuant to CPL 60.50

  • Junk science was used as evidence

  • Marsden did not receive fair trial

THE OSBORNE ASSOCIATION

New York Initiative for Children of Incarcerated Parents
The Osborne Association established the New York Initiative for Children of Incarcerated Parents in 2006, following the creation of the Children of Incarcerated Parents Bill of Rights in San Francisco. Since that time, they have published A Call to Action: Safeguarding New York’s Children of Incarcerated Parents, been recognized as White House Champions of Change, advised on the Sesame Street Toolkit on parental incarceration, and launched the national See Us, Support Us campaign. They lead efforts to restore free prison visiting buses in New York state, bring parents in prison closer to their children, and ensure that all government entities with arrest authority implement child-sensitive arrest procedures.

This organization offers a place of hope, where people who have been affected by the justice system join together in solidarity, and lift one another up. They live in  communities we they serve, and our services hinge on the connections they form with each person who passes through our doors. They also provide youth empowerment , recovery & wellness, housing and educational training.

Justin Bonus is the powerhouse attorney currently representing Nelson Cruz & Ricardo Marsden in their wrongful conviction case. Justin has a extensive history in getting convictions overturned. Justin  has a history of  Writing motions , suppress and supporting memorandum of law for  motions. Completed extensive research of Massachusetts criminal law. Assisted attorneys in developing strategy during both pretrial and trial. Participated in client interviews and in investigations. He also has experience in Drafting producer,management, recording, licensing, and endorsement agreements. Participated in negotiations with attorneys and clients. Established and maintained relationships with many clients. Acted as a liaison between start-up companies and the law firm. Developed marketing and branding strategies and techniques for both individual artists and independent record labels.

DERRICK HAMILTON

Derrick Hamilton was exonerated in 2015, after being wrongfully convicted of murder in 1991.  Hamilton began studying in the prison’s law library, eventually teaching himself enough criminal law to become “one of the most skilled jailhouse lawyers in the country.” Hamilton would lend help to his fellow inmates, guiding them to passages in legal texts that were relevant to their own cases.Hamilton currently has his own law firm working side by side with well known attorney's such as Justin Bonus , Johnathan Edelstein and more. collectively these powerhouses work in diligence overturning wrongful convictions.

Fett of EEP Civil Rights Division,Defend cases involving government abuse and wrongdoing. this power team represents people who are wrongfully convicted, assaulted , or has experienced the tragedy of losing a loved one to police misconduct/violence. EEP's Civil Rights division has represented DERRICK HAMILTON,JOSEPH JACKSON,JOHNNY HINCAPIE & NORMAN ALLEN in civil suits for their wrongful convictions. EEP Will be filing civil suits for soon to be exonerated NELSON CRUZ & RICARDO MARSDEN.
